Terms of Service

These General Terms and Conditions govern the business relationship between CREATIVELIBRE OÜ (hereinafter "CREATIVELIBRE") and its clients. By using our services, you agree to these terms.

1. Scope

These terms apply to all services provided by CREATIVELIBRE OÜ, registered in Estonia (Reg. No. 14740321), including but not limited to web development, digital marketing, AI automation, SaaS products, and consulting services. Deviating terms of the client are not recognized unless CREATIVELIBRE explicitly agrees to them in writing.

2. Services

CREATIVELIBRE provides digital services including website and application development, online marketing, AI automation solutions, video marketing, IT consulting, IT infrastructure management, and SaaS products. The specific scope of services is defined in individual project proposals or product descriptions.

3. Orders & Contracts

A contract is established when CREATIVELIBRE provides a written project proposal (quote) and the client accepts it in writing (including email). For SaaS products, the contract is established upon purchase through our payment platform. CREATIVELIBRE reserves the right to decline orders without stating reasons.

4. Pricing & Payment

Prices are as listed in the respective quote or product page. All prices are net amounts; applicable VAT will be added where required by law. For project-based services, payment terms are specified in the individual quote (typically 50% upfront, 50% upon delivery). For SaaS products, payment is processed at the time of purchase.

5. Delivery

Digital products are delivered electronically immediately upon payment confirmation. For project-based services, delivery timelines are estimated in the project proposal and are non-binding unless explicitly stated otherwise. CREATIVELIBRE will use commercially reasonable efforts to meet estimated timelines. The client must review and accept deliverables within 14 days of delivery; otherwise, deliverables are deemed accepted.

6. Refund Policy

For digital products: The statutory right of withdrawal (EU Directive 2011/83/EU) does not apply to personalized or individually tailored digital products and services, as these are produced specifically for the customer and cannot be resold (Art. 16(c) of the Directive). This includes, in particular, individualized analyses and reports. For standardized digital products without personalization, we offer a 30-day money-back guarantee from the date of purchase — no questions asked. To request a refund, contact us at hello@creativelibre.com with your order details. Refunds are processed within 5–10 business days. For agency/project services: If CREATIVELIBRE is unable to deliver the agreed services, the client is entitled to a pro-rata refund for undelivered portions. Once work has been delivered and accepted, it is not eligible for a refund. Partial deliverables that have been accepted are billed proportionally.

7. Intellectual Property

Upon full payment, the client receives non-exclusive usage rights for all deliverables created specifically for their project. CREATIVELIBRE retains all intellectual property rights until full payment is received. CREATIVELIBRE reserves the right to use anonymized project references for portfolio and marketing purposes unless otherwise agreed. Open-source components used in projects remain under their respective licenses.

8. Liability

CREATIVELIBRE's liability is limited to cases of intent and gross negligence under Estonian law. In cases of minor negligence, liability is limited to the contract value of the respective project. CREATIVELIBRE is not liable for indirect, consequential, or incidental damages, including lost profits. Force majeure events (including but not limited to natural disasters, pandemics, government actions, or infrastructure failures) release CREATIVELIBRE from its obligations for the duration of the event.

9. Governing Law & Jurisdiction

These terms are governed by the laws of the Republic of Estonia. The exclusive jurisdiction for all disputes arising from or in connection with these terms is Harju County Court (Harju Maakohus), Tallinn, Estonia. For consumers within the EU, mandatory consumer protection provisions of their country of residence apply additionally.
